TERMS AND CONDITIONS OF THE ONLINE STORE
§1 General Provisions

These Terms and Conditions ("Terms") set out the rules for purchasing products from the online store ("Store") operated by ELBOX COMPUTER, with its registered office in Poland at ul. Zabłocie 39, 30-701 Kraków, NIP: PL6791026096, phone: +48 570 470002, e-mail: shop@elbox.com.

By placing an order, the Customer accepts these Terms.

The prices displayed in the Store include VAT only where applicable—i.e., when the delivery address is within the European Union and the Customer is not a VAT-registered business. For deliveries outside the EU or to businesses with a valid EU VAT number, prices may be displayed without VAT, and applicable taxes or duties may be added based on the shipping destination and Customer’s status.

All products offered in the Store are free from physical and legal defects.
§2 Orders

Orders can be placed through:
a) the Store’s online order form,
b) e-mail sent to the address indicated on the Store’s website. -
To fulfill an order, the Customer must provide accurate details for identification and delivery. The Store will confirm receipt of the order by e-mail. The Store reserves the right to reject or limit orders, or restrict payment options if the order raises legitimate concerns regarding the Customer’s data or payment credibility.

The terms applicable to each order—including price, product description, components, delivery method, and estimated time—are those visible on the Store’s website at the time of order placement.

Information presented on the Store’s website does not constitute a binding offer within the meaning of the Polish Civil Code.
§3 Payment

Accepted payment methods are listed in the “Payment Methods” section on the Store’s website.

Shipping cost is calculated automatically based on the dimensions, weight, and destination of the shipment and is shown in the order summary.

Orders are dispatched only after full payment, including shipping fees, has been received.
§4 Shipping and Delivery

Deliveries are made via UPS courier or postal service.

For card payments, order processing begins upon successful transaction authorization.

For other payment methods, processing starts once payment has been received in the Store’s bank account.
§5 Right of Withdrawal (Returns)

Customers who are consumers (natural persons acting for purposes not related to their trade or profession) may withdraw from the sales contract within 14 days without providing a reason.

The 14-day withdrawal period begins on the day the Customer (or a third party other than the carrier) receives the goods.

To withdraw, the Customer must send a clear written notice (e.g., via e-mail or post). A model withdrawal form is available on the Store’s website.

The Store will refund all received payments, including the cost of the cheapest available delivery option, within 14 days of receiving the withdrawal notice. The same payment method will be used unless otherwise agreed.

The Store may delay the refund until the returned goods are received or the Customer provides proof of return.

The Customer is responsible for return shipping costs and must return the goods within 14 days of notifying the Store. The return deadline is met if the goods are shipped within this period.

The Customer is liable for any diminished value resulting from handling the goods in a manner beyond what is necessary to inspect them.

Before sending any shipment from outside the European Union, the Customer must contact our service department (support@elbox.com) to determine proper labeling and required customs documentation. Failure to do so may result in the package being refused or additional customs charges, for which the sender is responsible.

The right of withdrawal does not apply to:
- customized or made-to-order items,
- unsealed software or media (CDs/DVDs) provided with hardware,
- other exceptions under applicable EU law.
§6 Complaints and Warranty

Complaints must be submitted with proof of purchase (receipt or invoice).

Defective or non-compliant goods should be returned with a description of the issue.

Complaints are processed within 14 business days of receipt. If expert analysis is required, the response time may be extended accordingly.

If a complaint is accepted, the Store will cover the costs of returning and/or replacing the goods.

Minor variations in product appearance due to screen settings or display differences are not valid grounds for complaint.

If a returned item is found to be fully functional and compliant with the order, the Store may charge the Customer for testing and return shipping.

The Store is liable for product conformity with the contract for a period of 2 years from the delivery date, unless a longer period is stipulated by law.

§7 Privacy and Data Protection

By placing an order, the Customer consents to the processing of their personal data for order fulfillment.

The Customer may opt in separately to receive promotional content and newsletters.

Customers have the right to access, rectify, or request the deletion of their personal data.

Data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR).

The Store uses cookies to enhance user experience. Use of the Store constitutes consent to the Cookie Policy.
§8 Intellectual Property

All content on the Store’s website (including images and product descriptions) is protected by copyright and may not be used without prior written consent.
§9 Limitation of Liability

The Store is not liable for indirect, incidental, or consequential damages resulting from the use or inability to use the Store’s services or products.
§10 Force Majeure

The Store is not liable for any failure to perform its obligations due to circumstances beyond its reasonable control (e.g., war, natural disaster, pandemic).
§11 Final Provisions

These Terms are effective as of their publication on the Store’s website.

The Store reserves the right to update these Terms. Orders placed before any changes will be governed by the version in effect at the time of order.

Any matters not covered by these Terms shall be governed by Polish law and applicable EU consumer protection regulations.
